各县、区人民政府,市政府各工作部门、各直属机构:
《宝鸡市生产安全事故隐患管理暂行规定》,已经市政府第十一次常务会议审议通过。 现印发你们,请认真贯彻执行。

第一章 总 则
第一条 为了切实加强各类生产安全事故隐患的预防、排查、整治、验收等 管理工作,防止和减少生产安全事故,保障人民群众生命和财产安全,根据《安全生产法》及有关规定,结合本市实际,制定本规定。
第二条 本规定适用于本市行政区域内所有从事生产经营活动单位及场所的生产安全事故隐患的管理。
本规定所称生产安全事故隐患是指所有生产、经营、集会的一切场所、设备及设施等方 面存在不安全状态、人的不安全行为和管理上的不安全缺陷,可能导致人员伤亡和财产损失 的各类危险因素。
第三条 生产安全事故隐患管理,坚持安全第一,预防为主的方针。
第四条 各生产经营单位以及负责城乡建设、公路交通、铁路运输、河 道水域、矿山森林等设施的管理单位对本单位或职责规定范围内的生产安全事故隐患管理负 直接责任。其主要负责人对本单位的事故隐患管理全面负责。各单位应建立事故隐患预防、 排查、整治、验收等管理工作制度,落实整治措施和资金,确保安全生产。
第五条 各级政府及其负有安全生产监督管理职责的部门,应在所管辖区域 或主管范围内对事故隐患的预防、排查、整治、验收负监督管理责任,应定期组织开展事故 隐患排查、治理工作,并进行监督检查。
第六条 任何单位和个人对一切事故隐患有权举报。当发现不符合安全生产 规定,威胁本人或他人生命财产安全的隐患或其他不安全因素时,有权向事故隐患单位或者 负有安全生产监督管理职责的部门报告;接到报告的人员按有关规定应当及时予以处理。
第二章 排查、评估与报告
第七条 各级政府及其部门、各生产经营单位应结合实际,组织专业性或综 合性的生产安检查,及时排查各类]事故隐患,对查出或举报的事故隐患应及时记录在案。
生产安全检查由各级政府及其部门、生产经营单位的主要负责人按其职责组织有关管 理人员和专业技术人员进行。
第八条 事故隐患等级参照国家规定的生产安全事故等级划分如下:
(一)特大事故隐患:指可能导致发生生产安全事故的伤亡人数或直接经济损失符合特大事 故等级标准。
(二)重大事故隐患:指可能导致发生生产安全事故的伤亡人数或直接经济损失符合重大事 故等级标准。
(三)一般事故隐患:除以上2项外的其他事故隐患。
以上各等[级事故隐 患中有较大社会影响的,应进行重点管理,列为重点事故隐患。
第九条 各事故隐患单位应组织有关管理人员和专业技术人员,对所查出的各类事故隐患进行评估,写出评估报告,由单位主要负责人审签。
确定为特大、重大和重点事故隐患的,应书面报告当地负有安全生产监督管理职责的部门。
第十条 事故隐患评估报告包括以下内容:
(一)事故隐患类别、等级;
(二)事故隐患影响范围和程度;
(三)整改措施;
(四)整改资金来源及其保障措施;
(五)负责整改的直接责任人和主要责任人;
(六)整改目标和期限。
第十一条 负有安全生产监督管理职责的部门接到事故隐患报告后,可对隐 患情况进行复核或复评,按管理权限报告同级政府和上一级负有安全生产监督管理职责的部 门。
第十二条 市级负有安全生产监督管理职责的其它部门及县区安全生产监督 管理局(以下简称“安监局”)每季度末向市安监局报送本季度对事故隐患排查、整治的统 计情况。省、市政府安排的各种安全生产大检查中查出的事故隐患,应在每次检查结束后10 日内,向市安监局报送检查情况和隐患统计情况。
第三章 治理、验收与销号
第十三条 各事故隐患单位对确定的事故隐患应建档立卡,实施跟踪管理。 按照有关国家标准或者行业标准限期认真地进行整改。
生产经营单位的主要负责人或者个体经营的投资人必须对本单位、本场所应具备的安全生产 条件和整治事故隐患的人、财、物等投入予以保证。
第十四条 对短期内难以治理到位的事故隐患,由事故隐患单位制定应急预案,落实防范、监控措。事故隐患排除、治理前或者排除、治理过程中无法保证安全的,当地负有安全生产监督管理 职责的部门应当责令从危险区域内撤出作业人员,暂时停产 停业或者停止使用;紧急情况下可由隐患单位现场决定先停用、后报告。
第十五条 事故隐患单位对经整治的事故隐患先进行自查,符合安全规定后 ,按事故隐患的管理权限,及时申请负有安全生产监督管理职责的部门进行审查验收;验收 合格后方可恢复生产经营或使用。
第十六条 负责验收的部门按市、县区隶属关系,分别书面报告市、县区安 监局予以销号。市安监局接到市级有关部门及县区安监局书面报告后,必要时可对整治情况 进行复查;市安监局对按有关标准和规定整改合格的事故隐患按管理权限进行销号,或者书面报告省安监局进行销号。
第四章 监督与管理
第十七条 安全生产管理坚持“谁主管、谁负责”的原则,按照国家和省上 有关法律法规规定以及市政府对安全生产工作的职责划分,市级各负有安全生产监督管理职 责的主管部门对下列事故隐患行使监督管理:
(一)道路交通、消防、民用爆炸物品、烟花爆竹的事故隐患由市公安局负责;
(二)锅炉、压力容器、电梯、防爆电器、游乐设施等特种设备的事故隐患由市质量技 术监督局负责;
(三)公路设施、汽车客(货)运站(场)、水运码头及其交通运输工具的事故隐患由 市交通局负责;
(四)水利设施、水域、河道及其岸线的事故隐患由市水利局负责;
(五)燃气工程的设计、施工、安装和从事燃气生产、储存、运输、输配、销售(含自产、 自购燃气供本单位使用)及燃气器具生产、销售、安装维修的事故隐患以及城市供水、公共 交通等公用设施的事故隐患由市城市建设局负责;
(六)旅游景点的事故隐患由市旅游局负责;
(七)森林火灾事故隐患由市林业局负责;
(八)房屋事故隐患由市房管局负责;
(九)中小学校危房的事故隐患由市教育局负责;
(十)地质灾害事故隐患由市国土资源局负责;
(十一)农用机械事故隐患由市农业局负责;
(十二)危险化学品事故隐患分别由危险化学品生产、储存、经营、运输、使用单位的行业 主管部门、审批和办理许可证的部门负责;
(十三)大型群众集会和群活动的“安全应案”及活动场[KG-所[的事故隐患由活动审批部门负责 。
各从事生产、经营活动单位未列入前款的各类事故隐患由其行业主管部门负责;危险性较大 行业的事故隐患由法律法规授权的部门负责。
各负有安全生产监督管理职责的部门在检查中发现或接到群众举报的事故隐患及不安全问题 ,按照安全生产监督管理职责应当由其它主管部门负责监督管理的,检查和受理举报的部门 应及时书面移送相关部门,接受移送的部门应当及时进行处理。
第十八条 市安监局按照“综合监督管理”的职能,对事故隐患行使以下管 理职责:
(一)督促有关主管部门、管理机构和下级政府的事故隐患排查、整治工作,并 定期通报情况;
(二)对检查、举报或接到报告的特大、重大、重点事故隐患及时下发整改通知,实施严密 监控,并督促检查或协调处事故隐单位在隐患评估、排 除、治理、验收等过程中的重点、难点问题;
(三)负责全市各类事故隐患的建档立卡、统计上报和审查销号工作;
(四)协调市安全生]产专家委员会为部门和单位评估、治理事故隐患提供安全技术咨询服务;
(五)对违反本规定的行为进行调查,提出处理意见。
第十九条 各主管部门应对事故隐患的整治情况实施动态监督管理,跟踪检 查;对不按要求进行事故隐患整治的单位,应下达“督促整改通知书”,责令其限期整改。
第五章 责 任 追 究
第二十条 生产经营单位未按本规定进行安全生产检查或因工作疏忽未查出 事故隐患,经主管部门或安监部门查出存在的事故隐患,不论是否发生生产安全事故,主管 部门或安监部门都要对事故隐患和责任单位进行通报批评,并责令限期进行整改,逾期不整 改的,逐级追究领导责任;由此造成重、特大生产安全事故的,按《国务院关于特大安全事 故行政责任追究的规定》、《陕西省人民政府关于重大安全事故行政责任追究的规定》追究 行政领导责任;构成犯罪的,移送司法机关追究刑事责任。
第二十一条 事故隐患单位对事故隐患不整治或因人、财、物等投入不足而 导致事故隐患不能消除或发生生产安全事故的;事故隐患单位接到停产、停业整治或者停止 使用的决定而未停产、停业整治或者停止使用的,按“关口前移”的规定进行责任“倒查”,逐]级追究]领导管理责任;并按照《安全生产法》的规定予以处罚;构成犯罪的[KG-,移送司法机关[追究刑事责任。
第二十二条 县区政府、市级部门及管理机构未按本规定对事故隐患进行监 督管理,或不按要求对事故隐患的整治情况进行验收的,在年终岗位目标责任制考核时,对 其考核成绩予以扣减,并按《安全生产法》的有关规定,对相关责任人给予行政处分。
第二十三条 负有安全生产监督管理职责部门和工作人员,对事故 隐患不履行其监督与管理职责的,按《安全生产法》有关规定予以查处。
第六章 附 则
第二十四条 各县区政府可依照本规定制定本县区生产安全事故隐患管理规 定。
第二十五条 本规定应用中的具体问题,由市安监局负责解释。
第二十六条 本规定自发布之日起施行。

This Ordinance may be cited as the Money Lenders Ordinance.
This Ordinance shall have effect notwithstanding any agreement

PART II LICENSING OF MONEY LENDERS

No person shall carry on business as a money lender--
without a licence;
at any place other than the premises specified in such licence;

A licence shall be in the prescribed form.

An application for a licence shall be made to the Registrar in

Where an application is lodged under section 9 (5), the

2) (b) (i), a magistrate sitting with 2 assessors.
Without limiting the generality of the power of the licensing
court

r section 9 (5), the licensing court shall, where--
it is constituted by a magistrate sitting alone; and
it grants leave under section 11 (2) (b) (ii) to a person to object

Where the licensing court is constituted by a magistrate sitting

Where under this Ordinance the licensing court is required
